These General Terms and Conditions apply to all orders placed by consumers and businesses via the online shop of DNT83 UG (haftungsbeschränkt).
Consumers are natural persons who conclude a legal transaction for purposes predominantly outside their trade, business or profession. Businesses are natural or legal persons or partnerships with legal capacity acting in the exercise of their commercial or self-employed professional activity.
The products displayed in the online shop do not constitute a legally binding offer, but a non-binding invitation to submit an order.
The customer may initially place products in the shopping cart without obligation and may correct their entries at any time before submitting the order.
By clicking the order button, the customer submits a binding offer to conclude a purchase contract.
The provider may accept the customer's offer within a reasonable period by means of an express order confirmation or by dispatching the goods.
Important
Use of the online shop, participation in auctions, and purchases are exclusively permitted to persons who have reached the age of 18 years.
The use of the online shop, participation in auctions, and the purchase of products are exclusively permitted to persons who have reached the age of 18 years.
By registering or signing in via the app, the user expressly confirms that they are at least 18 years old. This confirmation is a prerequisite for using the account and participating in the marketplace.
The provider is entitled to request proof of age if in doubt, and to suspend or delete — without prior notice — accounts of users who do not meet the minimum age or who have provided false information.
Minors may neither participate in auctions nor make purchases through the online shop. Contracts concluded in breach of this age requirement are void.
Consent to newsletter: During registration or sign-in via the app, users are offered the option to consent to receiving a newsletter. Consent is given by actively checking the corresponding checkbox and is voluntary — it is not a prerequisite for using the online shop or completing registration.
Newsletter content: The newsletter contains information about current offers, promotions, new products, auctions, and other news relating to the online shop of DNT83 UG (haftungsbeschränkt).
Use of email address: The email address provided at registration is used for: sending the newsletter (where consent has been given); transactional communications such as order confirmations, shipping notifications, and invoices; and important account-related information such as password resets and security notices.
Withdrawal of consent: The user may withdraw their consent to receive the newsletter at any time with effect for the future — for example by clicking the unsubscribe link at the bottom of any newsletter, or by sending an informal notice to info@thecase-project.com. The lawfulness of processing carried out prior to withdrawal remains unaffected.
Further information on the processing of personal data, including email addresses, can be found in the provider's Privacy Policy.
All prices are in euros and include statutory VAT where applicable, plus the shipping costs indicated in each case.
The payment methods shown during the order process apply. The purchase price is due immediately, unless otherwise stated in the respective offer.
In auctions or comparable special sales formats, the buyer is obliged to pay the total amount due within 24 hours of receipt of the payment request or invoice, unless a different period is specified in the respective offer.
In the event of payment default, the statutory provisions apply.
Delivery is made to the delivery address specified by the customer.
Delivery times are stated in the respective offer or during the order process.
If an ordered product is exceptionally not available, the customer will be informed without undue delay. Payments already made will be refunded promptly in this case.
The delivered goods remain the property of the provider until payment has been made in full.
Consumers generally have a statutory right of withdrawal of 14 days for distance contracts.
The legal details of the right of withdrawal are set out in the provider's separate withdrawal policy.
Mystery Packs contain randomly assembled items from the product category described in each case. No specific composition or individual item is owed unless otherwise stated in the respective offer.
A return, withdrawal, or complaint solely on the grounds that the contents do not subjectively meet the buyer's expectations is governed exclusively by statutory provisions. Statutory warranty rights remain unaffected.
Mystery Packs are delivered sealed. Opening the seal automatically leads to the exclusion of the statutory right of withdrawal.
Individual products may additionally include a card with a QR code and an individual 6-digit code for activating a digital certificate of authenticity. The code is personally assigned to the respective buyer and can only be used once for activation.
The digital certificate of authenticity constitutes digital content. The right of withdrawal expires prematurely only if, before activation, the buyer expressly agrees that performance shall begin before the end of the withdrawal period and confirms that they thereby lose their right of withdrawal.
The express consent under paragraph 5 must be obtained separately in the order process. Mere agreement to these GTC is not sufficient for this purpose.
Insofar as the digital certificate is created or personalized individually for the buyer, the statutory provisions on the exclusion or premature expiry of the right of withdrawal apply only to the extent permitted by law.
In the event of withdrawal, the consumer shall bear the direct costs of returning the goods, provided that the provider has duly informed the consumer of this before conclusion of the contract.
The statutory provisions on liability for defects apply.
In relation to businesses, the limitation period for claims for defects in newly manufactured goods is one year from the transfer of risk, to the extent permitted by law.
The provider is liable without limitation for damages resulting from injury to life, limb, or health, and for damages based on intent or gross negligence.
In the event of slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract.
Otherwise, liability for damages caused by slight negligence is excluded to the extent permitted by law.
Liability under the Product Liability Act remains unaffected.
All content of the online shop — including texts, images, graphics, logos, designs, product photos, videos, and databases — is protected by copyright, trademark law, or other intellectual property rights.
Any use, reproduction, editing, distribution, public communication, or other exploitation outside the limits permitted by law requires the prior express written consent of the respective rights holder.
Where the customer is granted rights of use in connection with digital content, certificates, downloads, or other protected content, this is done exclusively to the extent required for the respective contractual purpose. Transfer to third parties or resale is not permitted without the express consent of the provider.
The provider stores the order data and the contract text in accordance with statutory provisions. The customer receives the order data and these GTC in text form in connection with their order.
The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods, insofar as no mandatory statutory consumer protection provisions conflict with this.
If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships is the registered office of the provider.
